Prerequisite(s):Application and concurrence are required prior to disturbance activity. Compliance with Section 401 of the CWA, Section 7 of the Endangered Species Act (ESA), and Section 106 of the 106 National Historic Preservation Act (NHPA) is required. Nationwide Permits (NWPs) could be used for projects provided permanent impacts are less than 0.5 acre. NWP 43 applies to stormwater management facilities. Regional General Permit (RGP) 7 is specific to construction of new flood control facilities and maintenance of existing flood control facilities In Clark County, Nevada if project impacts do not exceed 2 acres of impacts to wetlands or 5 acres of total impacts to waters of the U.S., including wetlands. If disturbance exceeds limits for a NWP or RGP7, a Letter of Permission (LOP) or Individual Permit (IP) would be required.
Processing Time:30 to 90 days if the project falls within an existing NWP or RGP7. LOP: up to 45 days. IP: 60 to 120 days.
