Regulated Activity:All CWA 401\ 404 regulated activities on tribal lands. Required as part of USACE Section 404 application process. Off-reservation 401 would be issued by the state. Tribes and Tribal Lands are not under jurisdiction of the state and therefore EPA administers this permit for them.
Prerequisite(s):Submit application to EPA with Best Management Practices (BMP's). Required prior to construction.
Processing Time:Approximately 60 days depending of project.

Submittal:Letter or short report, a copy of the USACE CWA Section 404 application, and BMPs
